“They want a cut”, New York Attorney General gets criticized for demanding restitution & penalties over Counter-Strike’s loot boxes on Steam

New York Attorney General Letitia James filed a lawsuit against Valve over the Counter-Strike loot boxes previously. She called it illegal gambling, that’s preying on young players. She even took on some major industry leaders with similar aggressive tactics to hers. However, this time, observers and gamers are not convinced by her offered official reasoning, as per which she is asking for full restitution for every loot box buyer, along with triple penalties. As per observers, why is the state, which already taxes sports betting at 51%, now suddenly asking for a cut from Steam?

On X, Letitia James consumer-protection reasoning collapsed under a wave of suspicion and mockery. As per observers, this lawsuit is a clear money grab, dressed as consumer protection. A post bluntly stated, “They want a cut”, pointing to New York state demanding a penalty that’s worth 3x of Valve’s related profit.

Another user noted about this apparent shift in energy stated, “NY state went from ‘Remove Gambling’ to asking for a piece of it…what do they really care about?”

The hardest of criticism came in from another user, who went ahead to call state officials “dregs of society” that would bankrupt a platform, which they touched.

Across all these comments and posts, a clear theme which emerged is one of skepticism. As per many, they are now skeptic if the Attorney General’s office genuinely wishes to protect teenagers from the slot-machine mechanics. The commenters argued that the state saw untapped revenue—especially as New York already taxed sports betting at 51% and took over $1 billion from this stream in 2024.

In February 2026, a lawsuit targeted Valve’s $2.49 digital keys, which were used for opening Counter-Strike 2, Dota 2 and Team Fortress 2’s virtual cases. Players using it received random cosmetic weapon skins, with rare items selling for 100s of 1000s of dollars—one of them in June 2024 fetched over $1 million.

As per the argument in NYAG lawsuit of James, this is quintessential gambling under the New York state law, as real money can buy a chance at real value. Despite this, Valve avoids age checks as well as taxes, which are required for licensed betting.

The demanded remedy by the Attorney General was harsh—full restitution for all New Yorkers who bought loot boxes, together with a 3x penalty on all the related profits, Steam earned since 2014. As per industry estimates, this penalty can go over and above $150 million.

Quite notably, the Netherlands and Belgium just blocked loot boxes, while France asked for transparency tools. It was New York alone that wanted to make a punitive financial cut—a fact which leaves many wondering, was it consumer protection or the state revenue which drove this entire fight?
